1. Definitions

2. Eligibility

You must be:

3. Nature of the Platform

  • No Real-Money Winnings: Games do not offer real-money prizes, cash-outs, or rewards.

  • No Gambling: The Platform does not constitute gambling or games of chance.

  • P1 Coins have no monetary value, cannot be exchanged for real money, and are used only for tracking performance or accessing features.

4. Account Registration

To access the Platform, you must create an account:

  • You must provide accurate, complete, and up-to-date information.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You are solely responsible for any activity that occurs under your account.

We reserve the right to suspend or terminate accounts suspected of:

  • Fraud

  • Botting or automation

  • Multi-accounting

  • Violating these Terms

5. Payment and Access to Games

  • Some games may require a one-time entry fee (visible on the game page).

  • All payments are final and non-refundable.

  • Payments are made solely to access entertainment services, not to purchase digital goods with real value.

  • No purchase is necessary to access some free parts of the Platform.

6. Virtual Currency (P1 Coins)

  • P1 Coins are virtual tokens earned through gameplay.

  • They are non-transferable, non-refundable, and hold no cash value.

  • Coins cannot be sold, traded, or withdrawn.

  • We reserve the right to modify coin values, limits, or balances at any time.

7. User Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose.

  • Attempt to manipulate or disrupt the fairness of any game.

  • Harass, threaten, or abuse other users or staff.

  • Use bots, scripts, or automated systems to access or play games.

We may ban or suspend users at our discretion for any misconduct or violation of these Terms.

8. Intellectual Property

All content on PlayerClub365, including games, branding, logos, and design, are the property of Smart Player Systems OÜ or its licensors.

  • You may not copy, modify, distribute, or create derivative works without permission.

  • User-generated content (e.g., usernames, chat messages) may be monitored and moderated.

9. Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis.

We make no warranties or representations regarding:

  • Availability or uptime of the Platform

  • Accuracy or performance of any game

  • Freedom from viruses or harmful components

Use of the Platform is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, profits, or opportunities

  • Unauthorized access to your account

Our total liability will not exceed the total amount paid by you to access the Platform in the last 30 days.

11. Indemnity

You agree to defend, indemnify, and hold harmless Smart Player Systems OÜ and its affiliates, employees, and agents from any claims or liabilities arising from:

  • Your use of the Platform

  • Your violation of these Terms

  • Your violation of any law or rights of a third party

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms.

Upon termination:

  • Your account will be deactivated.

  • P1 Coin balances and history will be forfeited.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users via email or platform notification.

Continued use of the Platform after changes constitutes acceptance of the new Terms.

14. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia, where our company is registered.

Any disputes will be resolved under the jurisdiction of Estonian courts, unless otherwise required by mandatory local law.
